Terms of Service

1. Scope and Acceptance

These Terms of Service (the “Terms”) govern your access to and use of the Orbly online store at https://bounce-wear.de, including purchases and related services (collectively, the “Services”). Orbly is a brand operated by Gökcay Baydar, a sole proprietor located at Dorstenerstr. 199, 46145 Oberhausen, Germany (“Orbly,” “we,” “us,” or “our”).

By using the Services or placing an order, you agree to these Terms and to the policies expressly incorporated into them. If you do not agree, do not use the Services. We will present the Terms for acceptance as required by applicable law. Any mandatory consumer rights that apply to you remain unaffected.

2. Eligibility and Accounts

You must be at least the age of legal majority where you live and have legal capacity to enter into a purchase contract. If you use the Services on behalf of another person or organization, you represent that you are authorized to bind them.

If account functionality is available, you must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account to the extent permitted by law.

3. Products, Information, and Availability

We sell pet products for dogs and cats. We aim to present product descriptions, images, materials, features, prices, and availability accurately. Screen settings and manufacturing variations may cause reasonable differences in color or appearance. A product description is not a medical, veterinary, safety, durability, or performance guarantee unless we expressly identify it as such in writing.

Products may be limited, changed, or discontinued. Supplier statements do not replace evidence required for objective product claims. We may correct material errors before accepting an order and will contact you if a correction affects an order you submitted.

4. Prices, Currency, Taxes, and Promotions

Our store’s base currency is EUR. Customers in our United States market see presentment prices in USD. The USD price displayed at checkout before you submit the order is the price charged for the products, excluding any taxes or charges separately disclosed at checkout. Exchange rates or conversion methods may cause displayed USD prices to change before an order is placed; an accepted order price will not be changed retroactively except where required to correct an obvious error and you agree to the correction.

Applicable sales or similar taxes, if any, will be shown at checkout where we are required and authorized to collect them. You are responsible only for taxes or charges lawfully disclosed and imposed on your purchase. Promotional terms, eligibility, duration, and exclusions will be stated with the promotion. Promotions may not be combined unless expressly stated.

5. Orders, Contract Formation, and Payment

Your order is an offer to buy the selected products under these Terms. An automated order-receipt message confirms that we received your order but is not acceptance. We accept your order when we send a shipping confirmation or otherwise expressly confirm acceptance. We may reject or cancel an order before acceptance because of unavailability, suspected fraud, pricing or description errors, shipping restrictions, or quantity limits. If we cancel after charging you, we will issue a full refund for the canceled portion.

You must provide current, complete, and accurate billing, shipping, contact, and payment information. Before submitting the order, you may review and correct the information shown at checkout. To request a correction or cancellation after submission, email gokcaybaydar@gmail.com promptly. We cannot promise cancellation after fulfillment has started, but mandatory cancellation rights remain unaffected.

Payments are processed through Shopify Payments and the payment methods displayed at checkout. By submitting payment details, you authorize the applicable charge and represent that you are authorized to use the payment method. Payment providers may apply their own terms and fraud-prevention checks.

6. Shipping and Delivery

We currently ship only within the United States. Orders are processed in 1–2 business days, Monday through Friday. Standard delivery is estimated at 5–8 business days after dispatch. These are separate periods and delivery times are estimates, not guarantees. Orders may be fulfilled from United States or China warehouses depending on product availability. We do not promise that any particular order will ship from a United States warehouse.

Standard shipping is $4.99 for orders under $50 and free for orders of $50 or more. Additional details are in our Shipping Policy. If these Terms and the Shipping Policy conflict, the policy or term that gives the consumer the greater mandatory protection will apply.

We will use a reasonable basis for shipping estimates. If we cannot ship within the promised time, we will provide any delay notice required by the FTC Mail, Internet, or Telephone Order Merchandise Rule. The notice will explain the revised date or that the delay is indefinite, your right to cancel without cost, and how any non-response will be treated under applicable law. Where express consent to a delay is required, we will not treat silence as consent. If you cancel, do not consent when consent is required, or we cannot ship, we will cancel the affected part and provide the full prompt refund required by law. A further delay will be handled with any renewed notice or express consent required by law.

Risk of loss and title pass only as provided by applicable law. Nothing in these Terms limits rights you may have against us for loss, damage, non-delivery, or defective products.

7. Returns, Defects, and Refunds

Our Return & Refund Policy is incorporated into these Terms. You may request a return within 30 days after delivery if the item is unused and in its original condition and packaging. You generally pay return shipping unless the item arrived damaged, defective, or incorrect.

For a damaged, defective, or incorrect item, email us within 30 days after delivery with your order number and photos. We will provide a free replacement or full refund; in many cases, no return will be required. These remedies and the Return & Refund Policy do not limit non-waivable warranty, product-liability, or consumer-protection rights. FTC delay or non-shipment refunds are governed by Section 6 and are not conditioned on a return or inspection.

8. Product Use and Safety

Use products only as described, select products appropriate for your pet, supervise use where appropriate, inspect products regularly, and discontinue use if a product is damaged or presents a risk. These general precautions do not transfer to you responsibility that applicable law places on a seller, manufacturer, importer, or other party.

9. Intellectual Property

The Services, including Orbly branding, site design, text, graphics, and other content supplied by us, are owned by or licensed to us and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping purposes.

You may not copy, reproduce, distribute, sell, exploit, reverse engineer, or create derivative works from protected portions of the Services except as permitted by law or with our written permission. If you believe content on the Services infringes your intellectual-property rights, send a detailed notice and supporting information to gokcaybaydar@gmail.com.

10. Reviews, Feedback, and Other Submissions

If the Services allow you to submit a review, feedback, image, video, or other content, you retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and adapt it only as reasonably necessary to operate, promote, and improve the Services, subject to applicable privacy law.

You represent that you have the rights needed for the submission, that it is truthful and not misleading, and that it does not violate intellectual-property, privacy, publicity, or other rights. Material connections, incentives, or free products related to a review must be clearly disclosed. We may moderate or remove unlawful, deceptive, unsafe, or rights-infringing content. This section does not state that photo/video uploads are currently available and does not claim a DMCA safe harbor.

11. Prohibited Uses

You may not use the Services to violate law or another person’s rights; submit fraudulent, false, abusive, discriminatory, obscene, or harmful content; introduce malware; interfere with security or operation; scrape or collect personal information unlawfully; impersonate another person; conduct unauthorized commercial resale; or attempt unauthorized access. We may restrict access for a material violation, subject to applicable law.

12. Third-Party Services and Links

Shopify hosts the store, Shopify Payments supports payment processing, and third parties support functions such as fulfillment, shipping, and customer communications. Third-party sites or services may have their own terms and privacy notices. We are not responsible for an independent third-party site merely because we link to it, but this does not limit responsibility that applicable law places on us for our vendors, products, disclosures, or contractual obligations.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy controls if it conflicts with these Terms regarding personal-information processing.

14. Service Availability and Voluntary Warranties

We do not promise that the website will always be uninterrupted, secure, or error-free. To the maximum extent permitted by law, the website and non-product informational features are provided “as is” and “as available.”

Except for a product-specific written warranty expressly made available before purchase, we do not provide an additional voluntary product warranty beyond the Return & Refund Policy. We do not exclude or limit any implied warranty of merchantability or fitness for a particular purpose, statutory guarantee, written warranty obligation, or other consumer right that cannot lawfully be excluded or limited. Nothing here overrides an express product promise or remedy we make to you.

15. Limitation of Liability

To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, exemplary, or consequential economic damages that were not reasonably foreseeable when the contract was formed. For claims involving only direct economic loss and where a cap is lawful, our aggregate liability arising from the affected order will not exceed the amount you paid for that order.

The exclusions and cap above do not apply to fraud, willful misconduct, gross negligence, death or personal injury, damage to property caused by a defective product, mandatory product liability, breach of non-waivable warranties, or any liability or remedy that applicable consumer-protection or other law does not permit us to exclude or limit. Some jurisdictions do not allow particular exclusions or limits; in those jurisdictions, this section applies only to the maximum extent permitted by law.

16. Indemnity for Misuse

To the extent permitted by law, you are responsible for third-party claims caused by your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights. This section does not require a consumer to indemnify us for our own negligence, product defects, unlawful conduct, or breach, and does not limit consumer defenses or rights.

17. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access for material breach, fraud, security threats, or unlawful use, with notice where reasonably practicable. Termination does not cancel an accepted order or payment obligation unless we expressly confirm cancellation, and it does not affect rights or obligations that accrued before termination.

18. Governing Law and Dispute Resolution

These Terms and our contracts with you are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules, except that this choice does not deprive you of mandatory consumer protections that apply under the law of the country or U.S. state of your habitual residence.

Before filing a claim, you and Orbly are encouraged to try to resolve the dispute informally. Send a description of the issue and the requested resolution to gokcaybaydar@gmail.com. We generally respond to support messages within 24–48 hours. If the dispute is not resolved, either party may bring a claim in any court that has jurisdiction under applicable law. Nothing in these Terms imposes an exclusive German forum, waives an available small-claims procedure, or limits a consumer’s right to complain to a regulator or use another mandatory remedy.

These Terms do not require arbitration and do not contain a class-action waiver.

19. Changes to These Terms

We may update these Terms for legal, operational, security, or service-related reasons. We will post the revised Terms and update the “Last updated” date. Material changes will apply prospectively, and we will provide additional notice or obtain renewed consent where required by law. Changes will not retroactively alter an accepted order unless you agree or applicable law requires it.

20. Severability, No Waiver, and Entire Agreement

If a provision is unlawful or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, the order details, and policies expressly incorporated here form the agreement for your use and purchases, subject to mandatory law and any express product-specific terms provided before purchase.
